Newsletter – September 2015 – ESOS & Energy Tax Review Updates

ESOS Update – EA to relax deadline enforcement With 3 months to go to the ESOS deadline on 5th December, just 177 out of the roughly 10 000 eligible companies have submitted their ESOS compliance reports.  With only around 800 registered lead assessors this implies a huge workload to get reports in on time. With this in mind, noises from the Environment Agency suggest that the deadline for submitting ESOS reports is likely to be relaxed.  We understand that penalties for missing the submission date are unlikely to be enforced on the condition that the participant has started the ESOS auditing process before the 5th December. Enforcement is likely to be strict on participants who have done nothing however so it is still very important to get the process under way as soon as possible.  If you need to comply but are yet to set the wheels in motion, please contact us for a free ESOS consultation as soon as you can. The EA plan to publish some guidance on their approach to enforcement by the end of September. Business Energy Tax Landscape Review In our Summer Budget newsletter, we mentioned the announcement by the Chancellor that there would be a review of the ‘business energy tax landscape’.  We now understand from reliable sources that this consultation will begin at the end of September with a view to publishing the review in 2016. This review, expected to be HM Treasury lead, is anticipated to cover CRC, CCL, ESOS and GHG reporting and is likely to be radical.
